S&M NuTec, LLC Settles Greenies Class Action

A federal judge approved a joint agreement to dismiss the case between 10 pet owners and S&M NuTec LLC. All issues between the plaintiff and the maker of Greenies have been resolved. Several dog owners brought suit against the company in 2006, which has since sold to Mars Inc., alleging that Greenies caused severe throat and intestinal blockages in some dogs because they couldn't easily be broken down by a canine's digestive tract. Greenies were hard, green dog treats resembling a toothbrush that were made to freshen a dog's breath.

On May 4, 2006, a class action was filed in the United States District Court for the Central District of California on behalf of a nationwide class of consumers who purchased Greenies(r) dog treats, the original green smart treat(r), and the general public. The defendant is S&M NuTec, LLC. The complaint alleges that NuTec has been marketing, advertising and selling Greenies since 1998 and that Greenies are 100% edible and highly digestible. However, plaintiff claims that the consumption of Greenies by dogs has not only been responsible for severe esophageal and/or intestinal problems, it has also led to the death of numerous dogs. In fact, the complaint alleges that pieces of Greenies have become lodged in dogs' esophagi and intestines, creating obstructions and causing serious medical problems. The complaint also alleges that the Company was well aware of the types of problems caused by Greenies, but that it did not take any affirmative action to warn consumers of the potential for these types of problems.
MGP Ingredients Sues NuTec and Mars

MGP Ingredients Inc. sued NuTec LLC and Mars Inc., alleging Mars stole trade secrets and infringed on patents. The suit alleges Mars interfered with Atchison, MGP's contract to provide ingredients for NuTec's dog treats.
